Terms and conditions

NowTalking (www.nowtalking.com) is provided to you by the company Inak, which is positioned and operating in Stockholm, Sweden. The purpose of NowTalking is to let members of NowTalking to find and communicate with old and new friends by using the diaries, guestbooks and other tools in NowTalking. Members of NowTalking will afterwards be known as "Members".

This page states the Terms and Conditions that you, as a member, have to follow to use NowTalking. By registering as a member to NowTalking you agree to be bound by the terms and conditions that are stated on this page for as long as you will stay a member. If you do not agree to the terms and conditions on this page, do not register as a member or use NowTalking in other ways! If you do not follow the terms and conditions stated on this page your membership will be terminated without any prior warnings or refunds.

Inak reserve the right to change the terms and conditions, the site (the features, existence and/or content of NowTalking) and/or the fees or charges for using the site at any time. Therefore you should visit and read this page from time to time since the terms and conditions on this page are binding on you.

To become a member you have to register at NowTalking with the form provided by Inak. By registering you agree to provide accurate, current and complete information about yourself as prompted by the registration form, to indicate that you are at least 16 years old, which is the minimum age to become a member. However, Inak can not guarantee that all members at NowTalking are at least 16 years old. Inak does not accept to take any responsibility for any members underneath 16 years old. If there are reasons to believe that a member is not of required age, Inak has the right to terminate that members membership without any refunds.

Username - When becoming a member you will be prompted to choose a username. Inak may not grant you permission to a username if the name may already be in use at NowTalking, may be offensive, may be a registered trademark, may be illegal or may be confusing in a way that it can harm other NowTalking members. Inak may also deny your access to a username after it has been registered, in case it doesn't fulfil those requirements or in case that the name is used in a way that it might be illegal, offend, or in other ways harm or confuse other NowTalking members in an unpleasant way.

Password - When becoming a member you will be prompted to choose a password together with your username. The member is responsible for choosing a password that, by common sense, can not be guessed or known by anyone else. The member may not tell or give the password away to anyone else. The member is also responsible for handling the password in a way that it can not bee seen, understood, guessed or known by anyone else. No one at Inak, or anyone else responsible for NowTalking, will ask you to tell send or give yours or anyone else's password away!

The membership - Each member is responsible for their own membership. The membership is for your own personal use and may not be lent, given, transferred or sold to anyone else. If you have agreed to pay a fee for your type of membership, your membership may be cancelled in case the fee is not paid in time. All fees paid are non-refundable. If there are any reasons for Inak to believe that you do not fulfil all NotwTalking's terms and conditions, your membership may be terminated without any refunds.

Member responsibilities - You, as a member, are responsible for all the content and information you upload to NowTalking in terms of text, files and other, including members presentation, members details, members diary, guestbook messages, mails, members gallery, forums, members friend descriptions and all other parts of NowTalking.

At NowTalking you agree as a member to NEVER...

... upload or send information or content that offend, discriminates, abuse, harass or threatens other members or non-members.
... upload or send information or content that is illegal according to your own country's or Swedish law.
... upload or send information or content that violates someone else's copyright or trademark.
... upload or send information or content for commercial purposes.
... gather information about other members for commercial purposes.
... upload, send, or by other means reveal, text or files with names, pictures, personal numbers, security numbers or other personal information of someone else.
... upload, send, or by other means reveal, text or files with your own surname, telephone number, street address, homepage URL or email address
... use any other language then English.
.... pretend that you are another person or entity then yourself.
... imply that you are employed by Inak or that any statements you make are endorsed by Inak.
... reproduce, or gather information to reproduce, the whole or parts of NowTalking or its content.
... upload or produce computer viruses or other computer code that may harm NowTalking, its functions, its equipment or other members of NowTalking.
... describe how to upload or produce computer viruses or other harmful computer code. If there are problems found with NowTalking, please notify us by filling in this form.
... manipulate the code of NowTalking to show something other then what it was originally intended for.
... use NowTalking for harmful purposes.
... hold Inak or NowTalking responsible for the content of other sites that may be linked from NowTalking.
... hold Inak or NowTalking responsible for content or information that has been uploaded or sent by other NowTalking members (each member is responsible for what they upload and send at NowTalking on their own).
... hold Inak or NowTalking responsible for any injury or death.
... hold Inak or NowTalking responsible for any damages, lost data, lost profits or other, resulted by the use, or inability to use, NowTalking (Inak will not cover any costs or losses that you might get because you choose or chose to use NowTalking).

Even though NowTalking is an international place it's positioned in Sweden and Swedish law must be followed at all times during your stay at NowTalking. You are also responsible for, and obligated to, follow the law in your own country. You agree to that Inak will not be held responsible if you do not succeed to do so. If you think that Inak and the community NowTalking breaks the rules in your country, it is your responsibility to leave NowTalking and cancel your membership. You agree to that Inak will not be held responsible for your visit at NowTalking even if NowTalking breaks any rules in your country. Inak will continue to follow the Swedish law!

Privacy policy - Inak may keep and use your personal information within the area of NowTalking. This helps us to help you to present yourself for other members, find other members and so on. However, Inak will not sell or give your personal information to any other companies or other outside the site of NowTalking. Still, Inak can not promise or prevent that noone else will find, gather or steal this information at NowTalking.

In case you have made, or are accused of making, anything that is illegal according to your country's or Swedish law, Inak may, but are not obligated to, share information and content from your NowTalking membership with the government that may help the government to solve the case.

Cookie information - Session cookies are used at NowTalking. Session cookies are only in use during your stay at NowTalking. Inak do not save any kind of cookie information from NowTalking or visiting members of NowTalking.
